The following is a legal agreement between You and the owners of Phi Power Communications, Inc. ("Phi Power"). Phi Power conducted the Network '06/07 Prime-Time Schedule Study in good faith and at its own expense, and considers the details and specific results of the study confidential and proprietary.

By purchasing the Network '06/07 Prime-Time Schedule Study research report and supportive data (collectively and separately identified as "Report"), You agree to be bound by the terms of this Agreement to maintain its confidentiality. If You do not agree with the Terms of Use, do not proceed to purchase this Report.

Limitations on Use - The Report is sold as a single-site single-user license. You may print a single copy of the Report for your use and within your organization, and may communicate internally and externally general findings, but may not distribute specific percentages, numbers, direct quotes, methodology, interactive dashboards, or design details to any individuals outside of your organization, including clients, partners, and the media, and must not allow the reproduction, republishing, or distribution of this study or its components internally without assuring they will be protected and kept company-confidential.

You may reference various contents of the Report treating it as you would any copyrighted material, but are liable for activities conducted by you or anyone else in your organization in connection with usage of the Report.

Notice of Identification - You are advised that each copy of the Report has embedded unique identification making breach of the Limitations on Use traceable.

Limitations on Liability - Phi Power does not warrant the accuracy, completeness, correctness, or other characteristics of any aspect of the Report. Phi Power will not be liable for any loss or injury resulting directly or indirectly from the Report, whether or not caused in whole or in part by Phi Power's negligence or by contingencies within or beyond Phi Power's control.

Indemnification - You agree to indemnify, defend, and hold harmless Phi Power and its officers, employees, shareholders, directors, and suppliers against all claims, liability, damages, costs, and expenses, including reasonable legal fees and expenses, arising out of or related to a breach of this Agreement, the use of this Report, and any claim by a third party related to the use of this Report.

Warranty and Liability - Phi Power makes no warranties, expressed or implied, regarding the products or services to be provided by Phi Power hereunder, and the warranties of merchantability and fitness for a particular purpose are expressly excluded.
